Wine-Specific Conditions

Legal Requirements

You must be 21 years of age or older, to order or receive alcoholic beverages from The Nice Winery or nicewines.com. Receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). Wines purchased from The Nice Winery or nicewines.com are not for resale, and are for personal consumption only.

Credit Card Charges

Orders are by credit card only. We accept Visa, MasterCard, Discover, and American Express. By joining any Nice Wine Club, you agree that your credit card will be billed and updated for the duration of your membership.

Minimum Purchase

No minimum purchase is required. We do require a minimum of 3 Wine Club Shipments when you join any level of the Nice Wine Club.

States Authorized for Direct Shipment

Due to the ever-changing nature of wine shipping laws, we may be able to ship wines, directly or indirectly, to states other than Texas. If The Nice Winery or nicewines.com is unable to ship directly to your state, we can arrange for the sale and shipment of our products through a third party. Please note, when dealing through a third party, wine prices, discounts, and shipping costs may differ from those quoted by The Nice Winery or nicewines.com.

Shipping Costs

Federal Express Ground is The Nice Winery or nicewines.com carrier of choice. Ground shipping is provided by Federal Express Ground at current market rates. *Note – If the customer selects FedEx Air as his or her carrier, the customer pays all shipping charges, regardless of his or her wine club membership or purchase amount.

Home Deliveries

The Nice Winery or nicewines.com discourages home deliveries for several reasons. If you elect to have wine shipped to your home address (rather than a business address or an address with a full-time attendant) The Nice Winery or nicewines.com is NOT RESPONSIBLE for redelivery costs or damages to the product that result from customer unavailability and/or missed shipments. Commercial carriers will make three delivery attempts and our licensed, bonded courier will make one. If the customer is not available in person for these attempts, the package is returned to The Nice Winery.

Please note that all carriers regardless of company or method of delivery will require an adult signature upon delivery, so the customer or the customer's designated adult attendant must be present to sign — in person — for any wine delivery. This is due to both state and federal laws. This is also the reason that carriers — not The Nice Winery or nicewines.com — charge additional fees for home deliveries.

Wine is a Delicate Commodity

Wine is a perishable commodity. Wine does not like extremes of temperature: hot humid summer and cold winter weather may adversely affect the condition of your wine during shipment. The Nice Winery or nicewines.com is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.

All wine is on an inexorable journey through time to eventually becoming a bottle of vinegar.  We take every precaution to store your wine in the most appropriate temperature controlled environment, but we cannot store your wine indefinitely.  Active club members must pick up their wine club shipment on a reasonably regular basis.  We will store wine for active wine club members for a maximum of 11 months.  After 12 months have passed, we will kindly donate your wine to one of the many local charities that request wine from us for their auctions and fundraisers.  Thank you for understanding our limitations for stoarge capacity and our inability to stop the natural aging of wine in the bottle.
